| 摘 要： | 宽严相济刑事政策应用于环境犯罪处置上，应当具体化为“宽严相济以‘宽’为主，以严济宽为辅”的刑事政策。而我国现阶段对于环境犯罪的处置则是“宽严失调”，即“该宽的不宽，当严的不严”。为此，需要从“宽”与“严”两个角度入手来完善我国环境犯罪处置模式，以便更好地体现和贯彻宽严相济的刑事政策。

| Abstract: | The criminal policy of temper justice with mercy shall be defined as ＂putting leniency first and leniency with severity＂ when it is applied to environmental crime disposition. But ehina＇s environmental crime disposition shows unbalance of leniency and severity. In another word, that is ＂adequate leniency or severity＂. Therefore, the disposal mode of china＇s environmental crime should be perfected from the two angles of leniency and severity in order to better embody criminal policy of temper justice with mercy. |
