| 摘 要： | 现有文献中对制度的论述很多,但比较凌乱和分散,不利于对制度的理解。笔者从制度的定义、制度的层次、制度的分类、制度的功能等方面对“制度”进行了一次全面梳理。旧制度学派和新制度学派在制度界定上存在着明显分歧;制度可以划分为两个、三个甚至四个层次;根据不同标准制度可以被划分为多种类型;制度具有信息传递、约束、激励以及提高效率和促进公平等功能。

| Abstract: | There are many discussions concerning "system" in the current literature,but the discussions are usually scattered and lack of order so that it is difficult to sort them out.The author aims to sort out the term "system" from its definitions,levels,types and functions.The traditional school and the new school of system differ greatly in the definition of system.System can be classified into two,three or four levels.Based on different standards,system can fall into many types.Finally,system has the functions of conveying the message,restraining as well as stimulating,increasing efficiency and promoting justice. |
