| 摘 要： | 随着法院调解的优势日益得到重视和发挥,刑事调解在刑事自诉案件纠纷解决上的作用也日益得到体现。作为法院调解的一个重要主体,法官能否发挥其应有的作用,是刑事调解程序能否顺利进行的重要因素之一。从现代的刑事调解理念出发,法官在刑事调解中应充分尊重当事人意愿,实现作为见证者、中立者、权威者和监督者的作用,以保障刑事调解工作的顺利开展及增强当事人和社会对刑事调解的信任程度。

| Abstract: | The criminal mediation in dispute resolution in the cases of criminal private prosecution shows more effective as the advantage of the court mediation appreciated nowadays.As the important subject in the court mediation,the judges must take effect.This is one principal element which affects the criminal mediation procedures.With modern ideas of criminal mediation,the judges must have respect for the ideas of the parties.In criminal mediation,the judge must be witness,neutral,arbiter and monitor in order to make criminal mediation procedures go well and make the parties and the society trust criminal mediation more. |
