| 摘 要： | 社科法学是中国的本土概念,尚未形成稳定的研究范式。合理性基础是中国社科法学出现的原因,直面挑战、实现价值证成是中国社科法学存续下去的关键。中国社科法学需要坚守法学学科本色;明确其他"社科"与"法学"的边界;克服外来研究方法与生产本土知识的矛盾;以全新的视角建构自身独特的概念工具与话语体系,求得学科发展的广阔空间。

| Abstract: | “Law and social science”is a native concept in China, which has not yet formed a stable research paradigm. The rationality foundation is the reason for the emergence of China’s law and social science. Completing the challenges and realizing the value justification is the key to the survival of Chinese law and social science. To earn a position in the future, China’s law and social science is supposed to adhere to the true nature of jurisprudence, distinguish jurisprudence from other social sciences and overcome the contradiction between the foreign research methods and the production of indigenous knowledge, construct its own unique conceptual tools and discourse system from a new perspective in order to obtain broad space for the development of the discipline. |
