| 摘 要： | 体育仲裁应当作为普通仲裁的有机组成部分,它们之间是从属关系。当然,体育仲裁也具有自身的特点,比如一定的强制性、时间上的紧迫性和仲裁机构的单一性等等,但这些特点并不能否定体育仲裁作为普通仲裁手段的存在。体育仲裁解决的仍然是普通民事主体之间的纠纷,相对的强制性也并没有违背意思自治的原义等,基于此,我们仍应当在统一的仲裁法框架内构建我国的体育仲裁体系。
