| 摘 要： | 在学习刑法过程中，故意和过失是两个非常重要的概念，也是学习刑法的过程中要重点掌握的内容。其中最容易迷惑人的就是间接故意与过于自信。本文通过心理因素中的认识因素和意志因素来界定间接故意与过于自信的联系与区别，可以让我们更加容易的区分出问接故意和过于自信过失，用来更好的指导实践。

The intentional crime in the indirect intentional and negligent crime of overconfident negligence often confusing. This article through psycho- logical factors in cognition and will to define the indirect intention and negligence of over confidence difference, let we in the criminal law study to better grasp the difference between indirect intention and negligence, so that a thorough study of criminal cases. |
