| 摘 要： | 新《刑事诉讼法》规定特别重大贿赂案件指定监视居住制度，实现了监视居住与逮捕强制措施的无缝衔接，增强了立法的科学性，但该规定过于原则。笔者认为，“特别重大”应以统一的数额标准、国家利益等方面来界定，居所应以宾馆、招待所等临时场所为限，检察监督以提请纠正权和惩戒权保障其效力的实现，以契合惩罚犯罪与保障人权并重这一立法宗旨。

| Abstract: | ＂The New Criminal Procedure Law＂ defines specified residential surveillance of the especially serious bribery case. It has realized the perfect combination of the residential surveillance and enforcement of arresting measure, and it also has improved the scientific level of making laws ; however, the regulation is lack of flexibility. In the author＇ s perspective, ＂ the especially serious＂ should use the unified amount standard and national interest as the dividing line. Residence should take hotel, inn and other temporary areas as boundary; what is more, to ensure the fulfillment of the potency of inspection and supervision, it should apply for the use of correctness power and punishment power and finally reach the goal of putting the punishment and assurance of human rights at the same important level. |
