| 摘 要： | 辩护律师对犯罪嫌疑人、被告人负有积极辩护的义务，同时又对法庭负有真实义务，二者之间存在一定的冲突。积极辩护的义务和真实义务相比，是辩护律师的主要职责、直接职责。真实义务要求对积极辩护的义务进行一定的限制。律师积极辩护义务的界限主要表现在如何对待虚假证据和如何对待职业秘密两个方面。

| Abstract: | The defense attorney has an zealous representation obligation to the defendant, and has a faithful duty to the court. There is a conflict between the two duties. Comparing with the faithful obligation to the court, zealous advocacy is the main and direct duty of the defense attorney. Faithful obligation to the court means a limit on the zealous advocacy. Limit on Zealous advocacy mainly means limit on the use of false evidence and limit on lawyer ——client privilege. |
