| 摘 要： | 刑法中国有公司、企业、事业单位受聘人员的身份问题在理论上与实践中都存在很大争议,而身份的界定直接影响到对行为人行为的定性.尽管在形式上刑法中的特定身份可以表现为个人要素,但实质上却体现为行为人对特定行为的特殊认识能力和控制能力.因而,实践中对行为人行为性质的认定与行为人是否具有国家工作人员的身份没有关系,而在于行为人对特定行为是否具有特殊认识与控制能力的资格.
