| 摘 要： | 罚金刑制度在我国环境犯罪中的应用顺应了世界刑罚轻缓化的趋势,有效弥补了短期自由刑的弊端,但还存在诸多明显缺陷,如适用范围狭窄、适用方式不当、数额确定不明、执行困难等,完善环境犯罪中罚金刑制度必须扩大罚金刑适用范围、完善罚金刑适用方式、取消无限额罚金制、废除随时追缴制、增设行刑时效制度。

| Abstract: | The using of the pecuniary penalty in the environmental crime conforms to the penalty-lightening trend of the times and functions as an effective remedy for the short-term penalty of deprivation of freedom.But there are a few obvious faults.On the basis of legislative analysis and research of China and other countries,the paper has raised some suggestions for the improvement of the pecuniary penalty in environmental crime. |
