| 摘 要： | 目前我国检察机关参与公益诉讼由于缺乏具体法律规定,其试点推动过程中引发了颇多争议。依据实践现状及相关理论分析,文章认为检察机关积极参与公益诉讼具有现实必要性,可行性和可操作性。文章对此进行了探讨研究,以期尽快建立检察机关参与公益诉讼的制度。最大限度地发挥检察机关保护国家和社会利益的作用。

| Abstract: | The present our country procurator agency participates in the public welfare lawsuit because lacks the concrete legal rule, in its experiment site impetus process has initiated the quite a lot dispute. According to the practice present situation and the correlation theoretical analysis, we thought the inspection institution positively participated in the public welfare lawsuit to have the realistic necessity, the feasibility and may operational. This article conduct the discussion research regarding this, established as soon as possible by the time, the procurator agency participated in the public welfare lawsuit the system. The maximum limit display procurator agency protected national and the social benefit function. |
