| 摘 要： | 随着社会经济的发展，现阶段我国有关精神损害赔偿的案件多了起来。学术界虽然在精神损害赔偿的研究方面有所进展，但是，我国精神损害赔偿制度一直被严格限定使用，这导致许多受到精神损害的当事人并不能得到法律的救济。这也体现出我国目前的精神损害赔偿制度有待于进一步成熟和完善。本人认为应该扩大精神损害赔偿的范围。增加严重违约行为和侵害贞操权行为进行精神损害赔偿的相关规定，增加刑事附带民事案件和国家赔偿案件对受侵害人的精神损害赔偿权力，完备精神损害的赔偿标准，完善精神损害赔偿的主体，增加非法人组织的精神损害赔偿请求权。

| Abstract: | With the social and economic development in China,The cases of moral damage compensation become more amd more.After the judicial practice and academia unremitting discussion,the study on the compensation for moral damage has been made some progress.however,However,the system of compensation for moral damage in China has been strictly limited to the applicability,and it leads to many litigants not be able to get legal relief.This also reflects the moral damage compensation system in China needs to be more mature and perfect.I think we should expand the scope of compensation for moral damage,increase serious breach and violation of chastity right behavior for mental damages provisions,increase the standard of criminal with civil cases and cases of state compensation for moral damages to the aggrieved person compensation authority,complete compensation of moral damage;perfect the main of the moral damages and the right of the unincorporated society claim for damages. |
