| 摘 要： | “亲亲相隐”最开始是作为一种伦理准则而存在的，在漫长的历史演变中逐渐成为一项法律制度。试图以法学与伦理学视角考察这一制度，论述了传统容隐制度的合理性和弊端，对区别于传统的“亲亲相隐”制度的现代容隐制度的建立做出一些探讨。
