摘    要:屋顶属于建筑物区分所有权中的共有部分,无论是否可以直接到达,全体业主在购房之后即取得所在楼盘屋顶的共有权,开发商无权将属于全体业主的共有部分出售给特定的个体.为了切实维护全体业主的建筑物区分所有权,有必要对关于屋顶是否配备直通楼梯的法律法规进行修改以排除隐患.

Abstract:The roof of a building is a common part of the condominium ownership. All of the homeowners acquire the co - ownership of roof right after house purchase whether it earl be directly reached by stairs. The developer does not have the fight to sell the roof which belongs to all of the owners to particular individuals. In order to effectively safeguard the condominium ownership of all owners, it is necessary to modify the laws and regulations on roof without direct stairs to a- void hidden dangers.
