| 摘 要： | 1992年德国刑事诉讼法修改后,卧底侦查制度步入成文法规制的轨道。德国通过立法与司法实践,对卧底侦查的主体、适用范围和条件、批准程序、身份保密和告知程序、卧底人员违法犯罪及处理、卧底人员取得证据之运用等都进行了全面的规范。因此,对其研究有利于我国在卧底侦查的立法与实践中参考与借鉴。
