| 摘 要： | 在宏观层面上,文章阐述假冒他人专利罪的认定问题后,在整个专利法体系下,对假冒他人专利行为进行深入剖析,明确非法实施专利行为、假冒他人专利行为、冒充专利行为的具体内涵;在微观层面上,文章分析假冒他人专利罪的准确适用.最后,论述了行为人为"假冒他人专利行为"后专利被宣告无效的法律后果,宣示了刑事诉讼中专利无效宣告程序的法律价值,并具体论述了刑事诉讼中与专利无效宣告程序的衔接处理问题.
