| 摘 要： | 超过有效期房产估价报告的证据资格在司法实践中常常发生争议，影响了司法审查对拆迁行政裁决合法性的判断。从房地产估价报告有效期的性质、估价时点的确定以及行政裁决的司法性这三个角度出发，超过有效期房产估价报告在证明拆迁安置补偿活动合法并进而证明城市房屋拆迁管理行政裁决的合法性中具有证据资格，应予以采信.
