| 摘 要： | 法学翻译是联系各国法律理论和实践成果的重要媒介.民国时期堪称近代中国法学翻译的鼎盛时期,其中宪政方面的译著尤为丰富醒目且意义重大.这些译著中,有来自不同国别、不同背景译者的作品,代表了不同的流派,反映了不同的宪政思潮.译者中既有本身具有社会影响力的法学家、翻译家,更有大量作为近代东西方文化交流媒介的留学生们.译者自身学术背景和价值观念各异,促使他们创作了不同风格的译著.宪政译著无疑对当时的政治思潮和实践均产生了重要的影响,而这些未能成功的宪政和其译著一起,给今日的宪法实践留下了经验与思考.

| Abstract: | Legal translation has been an important medium for learning from the West. The period of the Republicof China is one of the most significant periods among Modern China in the area of legal translation. Amongthese translations, there are numerous works which come from different countries and different translators of varietybackgrounds, representing different genres and reflecting different constitutional thoughts. The majortranslations are from UK, USA, France, Germany, Japan and other countries, covering both constitutional theoriesand theory of the state, including the constitutional system, comparative constitutional law and other aspects.The translators include both jurists who had inherently social influence and international students whoworked for cultural exchanges between Eastern and Western countries. The translators have their own academicbackgrounds and values, which encourages them to create different styles of translation. A large number of constitutionaltranslations bring prosperous constitutional thoughts, which makes a great impact on the politicaltheories and political practices at that time. The rich constitutional translations are still the valuable referencefor the transformation of today’s society. |
