| 摘 要： | 行为违反约定的或法定的义务，必然依法承担相应的民事责任。但违反受法律保护的善良习俗，行为人是否承担民事责任，由于《民法》规定不明确，造成司法实践中做法不一致，导致权利人不能得到全面的保护，应从立法上予以规范。

| Abstract: | If one violates the legal duty appointed he, according to the law, is bound to be charged, but when one violates the Social Custom protected by law, whether he is charged or not has become a confusion in many cases, because of the unclear definition in the General Regulation of Civil Law. The obliged cannot be fully protected. Therefore, a standard stipulation with regard to this should be included in the legislation. |
