| 摘 要： | 现代检察权是近代以来世界各国对分权制衡理论实践的结果。新中国建立后检察权在我国的发展经历了曲折的历程，其内涵也有多次变化，当前我国已经建立起一套系统的检察权体系，但实践证明其并没有如制度设计者设想的那样有效地履行法律监督职能。要实现检察权的科学发展，必须以分权制衡原则为基础，对检察权的权能作出合理的分配。

| Abstract: | The contemporary procuratorial rights result from the practice of the theory of power division in countries all over the world since modern times. After the founding of New China, drawbacks and difficulties emerged in the development of procuratorial rights, besides the changes in its connotation, after which, a systematic system of procuratorial rights has been set been carried out with procuratorial rights in the same be reasonably assigned and divided for procuratorial up. However, evidence shows that legal supervision has not way as the composers have expected. Therefore, power should rights following the division principles, in order to realize the scientific development of it. |
