摘    要:从我国关于比较广告的法律规定和实践来看.我国法律没有禁止采用比较广告的形式.但立法明确禁止直接比较广告和眨低性比较广告.因此我国对比较广告的立法态度和大陆法系国家一样,采取了"原则允许、例外禁止"的立法方式.面近年来随着欧盟广告指令在成员国实施以来,比较广告逐渐为国际上大多数国家所承认,而我国对比较广告的严厉禁止已严重影响我国的企业参与国际竞争.因此我国应尽快改进比较广告立法现状,建立长效的比较广告法律规范机制.以适应时代需要.

Abstract:Speaking of the regulations and practices of comparative advertising in our country, we have mever prohibited this kind of advertising, but we do have law that forbids direct comparative advertising and diminished comparative advertising, so can we say that we have the similar attitude like the civil law countries, which adopt the legislation manner of "principles permitted, exception prohibited". But with the carrying out of the EU advertising instructions in Europe, comparative advertising was gradually admitted internationally, and the strict prohibition of comparative advertising in China has severely affected the capability of companies in China, so we should improve the legislation and establish a long- term ruling system of comparative advertising to meet the needs of time.
