| 摘 要： | 行政诉讼中的举证责任是行政诉讼证据制度的核心问题,也是司法改革价值目标实现的一项重要证据制度。从行政诉讼举证责任的分配入手,结合我国现行行政诉讼法律规范,我们发现对举证责任进行分配非常必要。同时,对行政诉讼举证责任分配的实质和依据等相关问题进行探讨,可以使我们对原告和被告承担的举证责任做出初步分析。

| Abstract: | The burden of proof is not only a core problem in evidence system of administrative litigation, but also an important evidence system that concerns the realization of value target of fairness and efficiency in the judicial reform. Combined with the current administrative procedure laws and regulations, this article starts from the assignments of burden of proof. Then the author discusses the reason of assigning the burden of proof and elaborates on the essence and evidence of assignment of the burden of proof in order to analyze the burden of proof of plaintiff and defendant. |
