| 摘 要： | 2007年末颁布的新文物保护法较此前几部文物保护法，在立法原则和文物保护上有进步和发展，但也存在着诸如文物标准的界定、不同文物保护部门间的职能重叠、文物归属与权责、文物犯罪的认定与惩罚标准、流通与商品开发过程中判断合法与否标准等问题，而这些问题的形成是由立法规划、立法观念、法理学推定、文物保护机构长期以来的弱势地位等原因决定的。只有采取科学规划立法、更新立法观念、清理不合理法规、规范市场监管、做好法律宣传等措施，才能实现对文物的科学研究与合理利用。
