| 摘 要： | 承包地被征收而补偿的65万元发放到农户手中，还未发挥经济效用，就引起了一桩女儿告父亲的官司，围绕着款项的分割各执已见。承包地征收中农户与集体间就补偿款产生的纠纷在明确的法律规定下日趋减少，而农户家庭内部成员对于款项的分割又成了新时期诉讼的热点，能分还是不能分？谁有资格分？法律依据又是什么？实质就是对准共有财产的分割，在法律没有明确时可参照物权法关于共有的规定，但还是应尽快完善相关法律规定。

| Abstract: | The compensation of 650000 yuan,received by the farmer, caused a case in which the father was ac- cused by his own daughter for the distribution of that sum of money, around the money divided each hold. Of contracted land expropriation between farmers and collective disputes under the clear legal provisions is de- creasing, and farmers for the members of the family funds segmentation become hot spots of litigation in the new period again, can or can＇t split？ Who can tell？ What is law？ The author thinks that in fact this is the align ment of the joint property division, there is no specific law with reference to provisions of common law, but should perfect relevant regulations as soon as possible. |
