| 摘 要： | 我国的司法解释由最高人民法院和最高人民检察院实施，存在体制错位、法制不够统一、司法独立无法落实等弊端。因此应取消最高人民检察院的司法解释职能，实行以各级法院法官解释为主的与法律适用直接相联的司法解释。章还分析了实行法官解释制度的必要性及其意义，提出了实行法官解释制度应注意的问题。

| Abstract: | There are lots of disadvantages in China to vest Supreme People's court and Supreme Peoples Procuratorate with the power of judicial interpretation,such as malposition of legal structure, ununification of legal system and irrealization of judicial independence Therefore ,something should be done to abolish the judicial interpretation power of Supreme Peoples Procuratorate, and to implement a new rule which is related to the application of law and mainly vests judges at all levels with the judicial interpretation power. This article also analyses the necessity and significance to vest judges with the power of judicial interpretation and raises some questions which should be paid attention to while implementing the rule. |
