| 摘 要： | 中国意义上的司法能动已赋予其具有中国时代特色的新价值和新理念,践行司法能动是人民法院切实履行依法服务大局司法使命的时代要求,司法的“政治性、人民性、前瞻性和预见性”和司法的“中立性、规范性、公正性和权威性”是并行不悖的,在能动司法的推进中,必须遵循司法工作的基本规律,坚持司法公正与社会公平正义,在司法能动与司法中立之间寻求衡平.

| Abstract: | The judicial initiative in China has been given the new value and conception with Chinese characters. And the practice of such initiative is the demand of the time that the people＇s courts should carry out earnestly the judicial tasks. The judicial features of being political, serving people, prospectiveness are not contradictive with the judicial neutrality, standardi- zation, justice and authoritativeness. In practice of judicial initiative, we should follow the fundamental rules of judicial work, stick to judicial and social justice and seek for the balance between judicial initiative and neutrality. |
