| 摘 要： | 所谓“高校学生身份处分权”,是指高校依据法定事由剥夺学生的法律身份及其受教育权利的一种管理权力。与旧版《普通高等学校学生管理规定》相比,2005年新版《普通高等学校学生管理规定》在高校学生身份处分及其权利救济的制度安排上,体现了注重保护学生合法权益的法治精神。新版《普通高等学校学生管理规定》主要不足之处,则在其排除了学生寻求司法救济的可能性。

| Abstract: | The so-called "act disposition of the identity of college and university students" refers to a kind of management power that deprives students of legal identity and their rights to education according to certain laws.Compared with the old Management Regulations of College and University Students,the new Regulation embodies the spirit of rule of law which puts an emphasis on the protection of students' legal rights in its institutional arrangement of act disposition of the identity of college and university students and of its right remedy.However,the new Regulation excludes the possibility for students to turn to judicial remedy. |
