| 摘 要： | 结社自由是我国宪法赋予公民的基本权利之一，也是在民主法治条件下最大限度地实现国家与公民、政府与市场之间的利益统合的重要的法治原则与制度设计。笔者根据对我国当前结社活动普遍兴起和立法滞后的现状分析，认为有必要围绕《结社法》的制定，进一步解放思想，转变观念，正确认识和评价我国现阶段的结社活动；改革现行社团管理体制，实行由政府直接管理模式向政府间接管理和行业统一管理相结合的模式转换；加强结社法的基本理论研究，其中包括借鉴西方法团主义的制度理念，以促进我国社团法制的完善。

| Abstract: | The freedom of incorporation is not only one of the fundamental rights that the Constitution authorizes the citizen,it is also a fundamental principle and rule in a society ruled by law,protecting the interest between country and citizen,government and market. Considering the conflict between prevalence of the incorporation and the lag of the legislation,we need change our old notion and pay more attention to fundamental theory research,promote the reform of civil organization management system and legislation. |
