| 摘 要： | 新刑事诉讼法对自诉案件范围作了较大扩张,这种修改不符合起诉权发展的一般趋势,立法规定原则、简单,易引发诸多弊端,因而需要进行再修改和完善.本文在反思刑事自诉案件范围泛化所造成的一系列理论和司法实践问题的基础上,借鉴国外相关立法,提出了若干立法修改建议.

| Abstract: | The new criminal procedure law has expanded the range of case of private prosecution, this kind of modification does not accord with the general trend of prosecuting right development , legislate to stipulate the principle, simple, apt to cause a great deal of drawbacks, therefore need revising and perfecting.this article rethinking those questions and gives some suggestions on modifiction. |
