| 摘 要： | 知识产权保护中存在着多种利益冲突，其中最突出的是权利所有人与公众之间的利益冲突、发达国家与发展中国家之间的利益冲突。知识产权保护应当在相互冲突的利益之间寻求最佳平衡点以协调这些冲突，这样既可以促进科学化事业的发展又可以维护国内公正和国际公正。

| Abstract: | There are various conflicts of interests in the intellectual property protection. Of all, the conflicts between the interests of right-owners and of the public, between the interests of developed countries and of developing countries are especially significant. In the practice of intellectual property protection, we should do our best to find the optimal balance between these conflictive interests and to harmonize them so that the development in science and culture can be promoted as well as the justice domestic and international can be maintained. |
