| 摘 要： | 通过对清末洪仁?最早提出建立专利制度的主张、洋务运动时期中国专利制度畸形发展、"百日维新"时期颁布中国第一个有关专利的法规、清末新政时期成立了管理专利机构及其核准的专利以及清末有关专利制度的争论等历史事件的阐述,详细介绍了近代专利制度在中国萌芽的过程,并分析了当时的专利制度与西方专利制度的区别。

| Abstract: | By expatiating on the history affairs of the proposition of establishing the patent system in the end of Qing Dynasty by Hong Rengan,patent system abnormality developing in Westernization Movement,promulgating the first statute about patent in Reform Movement of 1989 in Qing Dynasty,setting up the institution to manage patent affairs in new policy reform in the end of Qing Dynasty and controversy about patent system,this paper detailedly introduces the process of the modern patent system germinating in China and analyses the difference of the patent system between the china and west countries in that era. |
