| 摘 要： | 目前，环境的污染和破坏日益加重，人类保护环境的责任也日益重大，国家作为环境公益的代表，在被赋予管理环境巨大权力的同时，也担负起保护环境的重大职责，然而现实中屡屡侵犯环境公共利益，我国司法体制又欠缺恰当的救济机制，使得环境公共利益得不到有效保障，因此，在我国建立环境行政公益诉讼极其迫切。本文将对环境行政公益诉讼进行分析，从原告资格、法院受理范围、举证责任分配等几个方面对构建环境行政公益诉讼制度加以探讨。
