| 摘 要： | 农民土地承包权是法律赋予农村集体经济组织成员的一种民事权利能力，而农户土地承包经营权是本农村集体经济组织的农户依承包合同生效而取得的一项具体民事权利。农民土地承包权与农户土地承包经营权不仅具有不同法律属性，而且各自具有独特之法律特征，其区别是显而易见的。同时，农民土地承包权是取得农户土地承包经营权的法律前提。理清农民土地承包权与农户土地承包经营权的内涵，有利于真正维护农村土地承包当事人的合法权益。

| Abstract: | Peasantry's land contract is a kind of capacity for civil rights endowed by law. However, farmer's land contractmanagement is a material capacity for civil rights, which become effective through farmer's contract in the rural collectivityorganization. Peasantry's land contracts and farmer's land contract management are of distinct law attributes and character. Inaddition, peasantry's land contract is precondition of farmer's land contract management. Clearing up the meaning of peasantry'sland contracts and farmer's land contract management does good to maintain the rights of the party in rural land contract. |
