| 摘 要： | 我国现行的宪法监督制度缺乏独立的专门宪法监督组织机构，监督主体模糊不清，监督机构未能实际建立；宪法缺乏可适用性，违宪审查缺乏根基；法律适用与宪法及法律解释相背离，导致违宪审查权虚置。由立法机关或司法机关行使宪法监督权的模式不适合我国国情。我国沿袭大陆法系，专门机构违宪审查模式是适合国情和现实需要的最佳选择。

| Abstract: | Without a special independent supervising organization, the supervising main body is obscure. Lacking of constitutional applicability and departing from the exploration to law and constitution lead to investigating violating constitution in name only. The mode of exercised constitution supervision by legislation or jurisdiction institution isn't reliable for Chinese condition. Pursuing the continent law, in China the mode of establishing a special institution investigating violating constitution is reliable for national condition and reality. |
