| 摘 要： | 未成年人犯罪是指已满14周岁不满18周岁的人实施的触犯刑律、应受到刑罚处罚的行为.近年来我国未成年人犯罪比率连续攀升,而检察机关的不起诉率极低.全社会都在热切关注未成年人的健康成长.本着对犯罪的未成年人教育、改造、挽救的宗旨,探讨如何在诉讼阶段发挥教育功能.并从未成年人犯罪不起诉制度本身的完善和不起诉之后教育挽救体制改革两个方面,立足于吸收借鉴,进行了初步的思考与构想.

| Abstract: | Juvenile crimes are the behaviours of violating the criminal laws,committed by the people who are over 14 years but less than 18 years,must be punished according to criminal laws.During the past years,there have been more juvenile crimes,but the noll pros rate of prosecuting braches has been very low.All the people in the world are concerning about the healthy development of juveniles.In order to educate,rehabilitate and rescue these juvenile criminals,we should think about how to bring into play the function of education in the stage of prosecution.This paper,having examined the noll pros system in China,talked about the necessity of reforming the system,and made some thinking and initiatives in the fields of improvement of noll pros system against juvenile crimes and helping and educating system reform in the view of absorbing and learning from other countries' successful experience. |
