| 摘 要： | “独立审判”是一个重要的司法原则。其实现必须：（一）、重新定位法院与其它国家机关及法院内部关系，以实现法官的职务独立，如重新定位法院与党的关系；法院与检察机关的关系；法院与立法机关的关系；法院与行政机关的关系；上下级法院之间的关系；法官与审判委员会，与庭长、院长之间关系等；（二）、努力为法官提供职务保障，实现法官人身独立。主要涉及法官的任句、工资、学习、培训等方面；（三）、努力树立法官权威，实现法官本身的独立。法官的权威主要来源于人们对法律、对法官的信任及法官的人格魅力，树立法官权威。

| Abstract: | Independent trial is an important judicial principle. To achieve this the following requirements are needed:1. Relocate the relationships between law court and other government organizations and the relationships within the law courts so as to achieve the judge's positional independence.2. Endeavor to provide security for judges and realize their personal independence in terms of promotion, salary, training, etc.3. Set authority for the judge. This authority comes from the people's understanding of laws and the judge's personality. |
