| 摘 要： | 对医患关系的法律定位直接关系到医疗纠纷的处理机制。目前学界主要有三种观点：一是行政法律关系，适用各种行政法规范；二是民事法律关系，适用民法规范；三是消费关系，适用消法。笔者认为，医患关系是以民事法律关系为主导的复合型法律关系。定性准确，才能更好地处理医患纠纷。

| Abstract: | It is directly rated to the settlement of medical disputes for us to confirm legal quality of the relationship between hospital and patients. At present, there are three Kinds of views: firstly, it is thougt to be administrative legal relationship, ought to use all different kinds of administrative legal norms; secondly, civil legal relationship ,to employ civil legal norms; last, consumer legal relationship, to be adjusted by consumer protection Law. The author think that the relationship between hospital and patients is the compound legal relationship in which is the civil legal relationship is essential. We must characterize it before settle better medical disputes. |
