| 摘 要： | 水资源的自然属性决定了水权不能完全等同于物权,水资源的社会属性决定了水资源在不同的用途上会表现出不同的性质,在某些用途上表现出私人产品的特点,而在另一些用途上又表现出纯公共产品的特点。水资源具有社会功能、环境功能和经济功能等多种功能,因此对水资源的管理既不能实行完全的政府行政化手段,也不能实行完全的市场化措施,而必须两者兼顾才能使多种功能得到充分发挥,从而使水资源产生最大的经济效益和社会效益。因而,我国水权管理体制应当采用政府的宏观管理与市场调节的微观机制相结合的模式。

| Abstract: | The natural characteristics of water decide that water rights arent fully equal to material rights. Water has varied characteristics in varied usages because of the social characteristics. It has the characteristics of private product or common product. Water resource has many functions such as social function, environmental function and economical function. Therefore, we should adopt the mode that combining macro -management with market adjustment to establish the water rights administration system. |
