| 摘 要： | 数据成为新型生产要素,如何实现数据要素的优化配置是数据经济发展的关键环节。数据交易是数据要素流动的重要通路,2020年《数据安全法(草案)》首次在法律层面提出要建立健全数据交易管理制度,规范数据交易行为,培育数据交易市场。在此背景下,应以利益均衡为基点对传统基本原则进行反思和再阐释,搭建数据权益保护和数据产业激励双层维度的基本规制原则。前者以知情同意原则、责任和安全保护原则为双足;后者以区分规制原则、合理使用原则为两翼,由此形成"保护-激励"双层维度的平衡性制度安排。

| Abstract: | Data has become a new factor of production.How to achieve the optimal allocation of data factors has become a key link in the development of data economy.Data trading is an important channel for the flow of data elements.In 2020,the Data Security Law(Draft)proposed for the first time to establish and improve the data trading management system,standardize the data trading behavior,and cultivate the data trading market at the legal level.Under this background,this paper reinterprets and explains the traditional basic principles based on the balance of interests,and sets up the basic regulation principles with two dimensions of data rights protection and data industry incentive.The former is based on the principle of informed consent and the principle of responsibility and safety protection,while the latter is composed of the principle of differentiated regulation and the principle of fair use,thus forming a balanced institutional arrangement with two dimensions of"protectionincentive". |
