| 摘 要： | 管辖是民事诉讼中的基本制度 ,在现行法律有了较为明确的规定下 ,实践中仍存在一些问题 ,如协议管辖与管辖权转移的效力冲突、管辖权异议制度的缺陷等。对此需从立法上加以完善 ,以促使民事诉讼追求的终极目的———司法程序的公平与公正的实现。

| Abstract: | Jurisdiction is a basic system in civil litigation. Although the present law regulates the civil jurisdiction comparatively clearly there are still some problems, such as conflicts on efficiency between concensual jurisdiction and transformation of civil jurisdiction, the shortcomings of objection to civil jurisdiction, etc.. which are to be improved by legislation for the ultimate goal or civil litigation: fairness and justice. |
