| 摘 要： | 欧洲是世界上区域性专利制度一体化进程最快、协调程度最高的地区之一，在现行的国家专利和欧洲专利的基础上，欧盟又在努力准备通过共同体立法的形式创立共同体专利。通过回顾欧洲协调地区专利制度的历程，比较分析了欧洲专利和共同体专利，阐明二者在并存局面下既区别又联系的状况，以利于把握欧洲专利制度协调的渐进过程和机理。

| Abstract: | Europe is one of the regions having the fastest development of patent system unification and highest level of patent system coordination in the world. European Union is going to establish the Community Patent in the way of community regulation based on the effective national patent and European Patent and reached the final policy decision preparation stage of council at present. In order to understand the mechanism and gradual course of the harmonization of the patent system in Europe, it analyzes comparably the European Patent and the Community Patent,and explicates the complicated relation of both through reviewing the historical evelopment of the coordination of the regional patent system in Europe. |
