| 摘 要： | 刑法目的是一个古老的命题,人们一直以来仅局限于报应主义和预防主义之争。其实,刑罚目的是多元的,随着法制文明的发展表现出一个逐次产生,由初级向高级发展的多元目的体系。报应和预防只是其中两个初级目的。今天,树立和巩固人们对法的忠诚与信仰,保障人权以及追求法治理想的实现依次成了人们创制和适用刑罚的更高目的,刑罚也正表现出更为理性的人文关怀。

| Abstract: | The end of punishment is an ancient topic which is limited in the doctrine of retributive punishment and the prevention of crimes doctrine. In fact, the end of punishment is plural, of which retribution and prevention are only the elementary purposes. With the development of law civilization,it has shown us a gradual system which changes from lower stage to higher stage. Now it has become the higher purpose of creating and applying punishment to build people's loyalty and faith to law and to protect human rights as well as to pursue the law-governed ideal. The punishment is showing more humanistic care of ration. |
