| 摘 要： | 美国私立大学实力雄厚，体制完备，在美国政治经济生活中发挥着重要作用。美国私立大学卓越成就的取得是与美国政府对其宽松、灵活的政策及宏观间接调控分不开的。法律作为一种重要的社会调控方式，也是美国政府对教育包括私立大学的宏观调控方式之一。相应的，私立大学的自治性和自发性的本质特征客观上也必然要求用法律来对其进行宏观调控。
