| 摘 要： | 社区服务刑(又称社会服务、公益劳动等)属于刑罚制度的范畴,主要适用于罪行比较轻微、不适宜监禁或者不适宜继续监禁的罪犯。这一制度符合刑法谦抑精神,有利于克服监禁刑的诸多弊端,减少社会对抗因素;也符合恢复性司法的发展方向,有利于社会和谐稳定。所以在西方国家已推行多年。笔者认为,我国刑法中有必要借鉴和吸收这一国外的先进法律成果,以完善我国的刑罚体系。

| Abstract: | The community service punishment(also called social work,social labor,etc) belongs to the category of criminal punishment system.It mainly applies to criminals who have committed relatively minor crimes,who aren’t suitable for imprisonment or those not suitable for continuing imprisonment.The system accords with the modesty and restraint spirits of criminal law.It helps to overcome the shortcomings of imprisonment,reduces the confronting factors of the society,and accords with the developing trend of recovery judicature,thus doing good to social harmony and stability.For all the above reasons,the system has been applied in western countries for many years.In order to perfect the system of Chinese criminal law,The author believes it necessary for Chinese criminal law to borrow and assimilate the advanced law achievements of foreign countries. |
