| 摘 要： | 行政自由裁量权有其存在的必要性，但如果行政自由裁量权在运行过程中因缺乏合理控制而导致滥用，势必会造成侵害行政相对人合法权益的不利后果。因此，加强对行政自由裁量权的控制以防止其滥用是十分必要的。实践表明，通过司法审查来控制行政自由裁量权以实现保障行政相对人合法权益的目的将是切实可行的有效途径。
