| 摘 要： | 教师职业的公共性源于教育的公共性和学校的公共性,教师权利及其界限的确立应以教师职业的公共性为基本价值。应当在确定不同类型教师法律身份的基础上,依据教师的公务性、专业性特征,具体规定教师不同性质的权利及其限度。
