| 摘 要： | 体育社会关系变化与法律观念的双重变迁使体育法观念随之发展。从历史发展阶段看,以神为本的观念表现为体育制度与宗教或祭祀制度相融合、偏重神意而轻视利益、服务于统治的目的;以物为本的观念表现为体育的商业性与公益性、职业性与全民性、民族性与世界性的紧张关系。体育法观念最终将走向以人为本的阶段,其核心思想是确立"体育人"的法律主体观。体育法将引导、规范并保障每个人参与、从事、分享体育运动。

| Abstract: | The change of social relationship on sports and legal idea promote the development of idea of sports law. Seen from history, in the stage with basis on gods, sports system blended in religion and fete system, focused on deity rather than benefits, and promoted theocracy. In the stage with basis on goods, there exist the tensions of sports between commerce and public welfare, between profession and population, and between nation and world. The trend is a new stage of with basis on human, which has a feature of cultivating sportive human beings. Sports law will guide,normalize and protect anyone to participate in, contribute to and enjoy sports. |
