| 摘 要： | 社会秩序的维持除了传统的行政强制措施,还存在着一些"软性"行政措施,例如行政指导、行政合同、行政奖励等等。这些措施虽不具有强制性,但是与行政强制措施比较起来,在经济成本、行政相对人的接受程度、适用的范围、公民权利的保护上存在着一定优势。在行政执法中应"软""硬"兼施。

| Abstract: | In addition to the traditional compulsive administration measures,there are some the gentle of administration measure to maintain the social order,for example the administration instruction,the administration contract,the administration reward.Although these measures are not compulsive,their have comparable advantage in economic costs,to the degree of acceptance of administration opposite person,in the application scope,in the protection of human rights,comparing with the traditional administration measures. |
