摘    要:雇佣关系的存在是雇主在雇员侵害第三人权益时承担替代责任的前提,因此判定雇佣关系成为解决这一问题的关键。然而我国法律却始终未对雇佣关系的标准作出明确规定,导致了司法实践的混乱。我国未来的立法应该借鉴其他国家的立法及理论学说,以控制监督标准为主,辅以组织标准、利益归属标准等其他标准;全面考量雇主替代责任的理论基础,明确雇佣关系的范围应该主要为经营性雇佣关系;同时将帮工人侵权责任统一规定为志愿者在志愿活动中的侵权行为适用雇主替代责任;对于劳务派遣中雇员的侵权行为,应明确规定用人单位和用工单位为共同雇主,对受害人承担连带责任。

Abstract:The existence of an employment relationship an employer against the third person in the rights and interests of employees take the premise of vicarious liability.Therefore we can determine the employment relationship as the key to solving this problem.But our law has not made the standard of employment relationship clearly defined leading to confusion in judicial practice.China's future legislation should learn from other countries.Full consideration of the theoretical basis of vicarious liability of employers and clearing the scope of the employment relationship should be the main operational employment relationship.Uniform provisions will help workers to volunteer infringement and vicarious liability for employers.For Employees violations on labor dispatch,the employer should be clearly defined as a joint employer and the employer shall be jointly and severally liable for the victim.
