| 摘 要： | 建设法治中国最重要的就是要建设法治社会。而软法是法治社会不可或缺的元素,应当根据法制统一的原则,把民间规则等整合为软法,并纳入国家的法治体系,使其规范化、制度化、法治化,以适应复杂多元的现代社会发展需要,并回应法治中国的新要求。软法与国家法治体系整合的基本要求,是在全社会树立法治思维,并在此基础上,制约软法、保障软法的实施。软法与国家法治体系整合的途径：一是创立软法制定与实施的程序规则,作为与国家法治体系接轨的桥梁;二是完善软法实施的组织机构体系,并与国家法治体系执行系统接轨。

| Abstract: | It is the most important to build a society by law in order to build China under the ruleof law. Soft law is the indispensable element in the society by law. According to the principle of unifi-cation of legal system, people should change popular regulations into soft laws and make them includedin the national legal systems to make them normalized, institutional and legal in order to adapt to com-plex modem society and satisfy new demands of China under the rule of law. The basic requirement forthe integration of soft laws and the national legal systems is to build the mind that the society needs tobe ruled by law in the whole society. On the basis of it, restrict and protect the implement of soft laws.There are two ways for the integration of soft laws and the national legal systems： the first is to createrules of procedures for the enacting and implement of soft laws as the bridge connecting the national le-gal systems ; the second is to develop the organization system, which helps the implement of soft laws,and make it connected with the national legal systems. |
